IsoEngine End User License Agreement

IMPORTANT - The IsoEngine End User License Agreement EULA is a legal agreement between you and First Productions, Inc. Read it carefully before purchasing and/or installing IsoEngine SDK/IsoEngine SDK Demo. It provides a license to use the engine and contains liability disclaimers.
By installing and using this product, you are confirming your acceptance of it and agreeing to become bound by the terms of this agreement. If you do not agree to be bound by these terms, do not purchase and/or install IsoEngine SDK/IsoEngine SDK Demo.
IsoEngine has three different licenses Demo License, Freeware License, and Commercial License. Anything in this license agreement that is marked with the licenses that you dont have do not apply to you.
1. Definitions
(a) Application means any application that was made using IsoEngine/IsoEngine Demo.
(b) Non-commercial means charging no money at all for an Application.
(c) Commercial means charging money for an Application.
(d) Evaluation means only using IsoEngine Demo for examination only; distribution of Applications is not permitted under any circumstances
(e) EULA stands for End User License Agreement.
(f) IsoEngine SDK/IsoEngine SDK Demo means IsoEngine/IsoEngine Demo and all of their components.
(g) IsoEngine Tools/IsoEngine Demo Tools means all of the tools that IsoEngine/IsoEngine Demo comes with.
2. License
This EULA allows you to:
(a) If you have a Demo License, install and use IsoEngine Demo for Evaluation purposes only.
(b) If you have a Freeware License, install and use IsoEngine to make as many Non-commercial Applications as you wish.
(c) If you have a Commercial License, install and use IsoEngine to make one (1) Commercial Application and make as many Non-commercial Applications as you wish.
(d) You may NOT decompile, reverse engineer, disassemble, or otherwise reduce any part of IsoEngine/IsoEngine Demo or IsoEngine Tools/IsoEngine Demo Tools to an understandable form.
(e) You may not modify IsoEngine/IsoEngine Demo or IsoEngine Tools/IsoEngine Demo Tools.
(f) With a freeware or commercial license, the users of any Application may not distribute IsoEngine (besides yourself).
(g) With a freeware or commercial license, you may only distribute IsoEngine as part of your Application. Under any license, you may not distribute IsoEngine Demo.
(h) In the event that you fail to comply with this EULA, your license will be terminated and you must destroy all copies of all parts of IsoEngine SDK/IsoEngine SDK Demo, including all copies of the IsoEngine/IsoEngine Demo DLL file.
3. License Descriptions
3a. Demo License
With a demo license, you may only use IsoEngine SDK Demo for Evaluation purposes only. In other words, you may only use IsoEngine SDK Demo for examination only; distribution of Applications is NOT permitted under any circumstances. You may NOT hide the IsoEngine Demo box that pops up after initialization, and you may NOT hide the watermark during rendering.
3b. Freeware License
With a freeware license, you may make as many Applications as you want for Non-commercial purposes only. You must give credit to IsoEngine, using (I), the name IsoEngine, and (II), the URL to its web site (www.firstproductions.com/isoengine) in the readme file, as well as in the about or credits section of all the Applications you make. You must make these two items easily readable by the user and can be visible for at least 5 seconds. You must also put the same two things in the readme file of your Applications
3c. Commercial License
With a commercial license, you may make only one (1) Commercial Application. You do not have to give credit to IsoEngine. You may also make as many Non-commercial Applications with this license as you want, under the conditions of the Freeware License.
4. Cost
A Demo License costs $0 USD.
A Freeware License costs $39 USD.
A Commercial License costs $99 USD.
5. Password
With a purchase of IsoEngine, you receive an unlocking password to use IsoEngine, as well as a second password to download and install IsoEngine. YOU MAY NOT GIVE ANYONE THESE PASSWORDS.
6. Obligations
(a) You are responsible for determining if your computer meets the system requirements for IsoEngine SDK/IsoEngine SDK Demo prior to purchasing a license.
(b) Whether you own a Demo License, a Freeware License, or a Commercial License, First Productions, Inc. is not obligated in any way to you.
(c) First Productions, Inc. reserves all rights to choose the speed of development of IsoEngine SDK and IsoEngine SDK Demo. First Productions, Inc. has sole claim on the development of IsoEngine/IsoEngine Demo and their components.
7. Ownership
First Productions, Inc. reserves all rights, including all copyrights to IsoEngine, IsoEngine Demo, IsoEngine SDK, and IsoEngine SDK Demo, and all of their copies. First Productions, Inc. reserves all rights not specifically granted in this EULA, including Federal and International Copyrights.
8. Disclaimer
Neither First Productions, Inc. nor its developers will be liable or responsible for any damages you, your business, or any third party may suffer, including, but not limited to the use or inability to use IsoEngine SDK/IsoEngine SDK Demo. First Productions, Inc. makes no warranties of any kind, expressed or implied, for our products, and disclaims any warranty or merchantability or fitness for a particular purpose. First Productions, Inc. reserves the right to amend or update these policies without notice. Failure to follow any terms and conditions will result in license termination.
